These Referral Program Terms (“Terms”) govern your participation in the Freshpet, Inc. (“we,” “us,” “our”) Freshpet Delivery referral program (the “Program”). By participating, you agree to these Terms and to our Terms and Conditions and Privacy Policy, which are incorporated herein by reference.
1) Eligibility & Territory
- Open to U.S. residents, age 18+ only. Void where prohibited.
- Delivery locations may be limited. Please review our website to determine if we deliver to your location.
- Program is for personal, lawful, non‑commercial use. Resellers and affiliates are not eligible.
2) How the Program Works
- Referral Link. We provide you a unique referral link (“Referral Link”). You may share the Referral Link with friends, family, or your social network by using your own email, text, or social posts or through our platform.
- Qualified Referral. A Qualified Referral is defined as a purchase made at https://www.deliver.freshpet.com by a person who arrives at our website by clicking your referral Program link (a “Referred Customer”). You are limited to one Qualified Referral for each Referred Customer. Additional or repeat purchases made by a Referred Customer do not count as additional Qualified Referrals.
- Referred Customer. The Referred Customer and the Referrer cannot be the same person (e.g., by using a different email address). Additionally, the Referred Customer must be a new Freshpet Delivery customer and cannot reside in the same household as the Referrer.
- Referral Rewards. For you to earn referral rewards as a Referrer, the Referred Customer must complete a purchase on the Freshpet Delivery website. There is no minimum purchase amount required. Rewards will not be issued for subsequent purchases by the same Referred Customer.
- Reward Payments. Rewards are payable in increments of 15%-off single order discounts. There is no maximum limit on the number of Qualified Referrals or total rewards earned per calendar year. As a Referrer, you are responsible for any and all tax liability resulting from Referral Rewards.
3) Reward Details
- Exclusions. The discount may not be applied to purchases of gift cardstaxes, shipping, handling, or where restricted by law. Not redeemable for cash. Non‑transferable. May not be combined with other codes unless we state otherwise.
- Issuance & expiration. The reward will be issued on your next order after your Referred Customer’s eligible order ships (and is not canceled/returned) There is no expiration date applied to your reward so long as your subscription remains active, but if you cancel your subscription the reward will be void, and cannot be applied to any new subscriptions in the future.
- Cancelled Orders. If the Referred Customer’s order is canceled, returned, charged back, or otherwise not completed, the related Reward may be revoked.
- Caps & abuse. We may set or change annual/overall caps (e.g., max [10] Rewards per calendar year) and may suspend or claw back any Reward obtained by fraud, self‑referral, or violation of these Terms.
4) Referral Emails Sent by Us
- If you use our platform to send referral emails, you authorize us to send an email to the recipient you designate. The email will identify Freshpet and will include our contact information and an opt-out mechanism as required by law. You agree to provide only email addresses of individuals you know personally and who would reasonably expect to receive a message from you. You may not use this feature for spam or unlawful purposes. We will use the recipient’s email address solely to send the referral email and will not retain it for marketing unless the recipient independently opts in.
5) No Unsolicited or Deceptive Messages; Required Disclosure by Referrers
- When you post or share the Referral Link, you must clearly disclose that you may receive a reward (e.g., “I may get 15% off my next order if you use this link”). Place the disclosure close to the link and make it hard to miss. See the disclosure guide below for more details and examples.
- You may not make claims about our products that are false or misleading. Only share honest opinions and experiences.
- You may share your Referral Link only with people you know and in ways that do not constitute spam, harassment, or unlawful marketing. Do not use bought lists, mass‑messaging tools, or automated systems.
- You agree not to send text messages regarding the Program unless you have each recipient’s prior consent to send the message to them.
- No Spam. You must comply with all applicable “SPAM” laws. Emails must be created and distributed in a personal manner. Bulk email distribution is prohibited. Any distribution of your referral link that could constitute unsolicited commercial email or “spam” under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your account and exclusion from the Freshpet Delivery referral Program.
6) Prohibited Conduct
- No self‑referrals, creating multiple accounts, referring household members at the same shipping address, or posting referral links on coupon sites, deal forums, or similar code‑sharing directories.
- No paid ads on brand terms or domains, impersonation of Freshpet, misdirection, or any conduct that could harm our brand or customers.
7) Taxes & Sales Tax Treatment
- Rewards are discounts on future purchases and have no cash value. You are responsible for any applicable taxes arising from your purchases and any associated discounts, earned through the Program or otherwise. We calculate sales tax on the discounted price where required by law.
8) Privacy
- We process your Program data (e.g., contact information, link IDs, attribution events, Reward status) as described in our Privacy Policy. By participating in the Program, you agree to our processing of your information in accordance with the Privacy Policy, including the section entitled “Notice of Financial Incentives and Right to Opt Out.” By participating, you also certify that you have the right to share with us the information regarding your referrals that you enter into our referral platform.
9) Changes; Termination
- Right to Cancel Program or Change Terms. We may change, suspend, or end the Program or these Terms (prospectively) at any time, with or without notice, including changing Reward values, caps, eligibility, and expirations. If we terminate the Program, unused Rewards will be forfeited at that time.
- Right to Close Accounts. Freshpet reserves the right to close the account(s) of any Referrer and/or Referred Customer and to request proper payment if the Referrer and/or Referred Customer attempts to use the Program in a questionable manner, breaches any of these Terms, or violates any law, statute, or governmental regulation.
10) Fraud; Suspension
- We may audit participation, withhold or revoke Rewards, or suspend accounts for suspected fraud, abuse, or violation of these Terms.
11) Limitation of Liability
- To the maximum extent permitted by law, Freshpet is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the Program.
- Please note that some jurisdictions may not allow the limitation of certain types of liability and damages and, as a result, some of the above exclusions and limitations may not apply to you.
Referral Disclosure Guide
This guide explains how to make clear and conspicuous disclosures when sharing referral links or codes, in compliance with the FTC Endorsement Guides. If you receive a benefit (such as a discount, credit, or reward) for referring others, you must disclose that connection every time you share your link or code.
Best Practices for Disclosure
- Disclose your benefit in plain language (e.g., “I get 15% off if you use this link”).
- Place the disclosure close to the referral link or code—don’t hide it in a profile or terms.
- Make it hard to miss: no tiny fonts, no buried hashtags, no ‘see more’ folds.
- Use the same format as your message (text for text, audio for audio, etc.).
- Avoid ambiguous hashtags like #ambassador or #partner alone; use clear language.

- “Hey! Use my link and I’ll get 15% off my next order: [your link]”

- Body: “I may get 15% off my next order if you use this link: [your link]. Thanks!”
Key Reminder
Always make your disclosure clear, unavoidable, and in easy to understand language. If you’re unsure, ask yourself: Would an average person understand that I benefit if they use my link? If not, make it clearer.

These Loyalty Rewards Program Terms (“Terms”) govern your participation in the Freshpet, Inc. (“we,” “us,” “our”) Freshpet Delivery loyalty rewards program (the “Loyalty Rewards Program”). By participating, you agree to these Terms and to our Terms and Conditions and Privacy Policy, which are incorporated herein by reference. If there is a conflict between these Loyalty Rewards Program Terms and Freshpet’s Terms and Conditions, these Loyalty Rewards Program Terms will govern solely with respect to the Loyalty Rewards Program.
Eligibility, Issuance & Availability
Participation in the Freshpet Delivery Loyalty Rewards Program is limited to individuals who have an active Freshpet Delivery account. Loyalty rewards are available to individual consumers for personal, non‑commercial use only.
Customers become eligible to receive loyalty rewards upon the successful processing of qualifying Freshpet Delivery orders (meaning the order has been processed and payment has been successfully collected) that qualify for a reward based on the criteria set by Freshpet. Rewards for which you are eligible will appear in your account and will ship with the order that achieves the requirements for the applicable reward, unless otherwise specified. Free or unpaid orders and replacement shipments do not count toward achieving rewards.
If multiple rewards are available, Freshpet may determine the order in which they are applied. Loyalty rewards cannot be applied retroactively to prior orders.
Loyalty rewards cannot be transferred between accounts, nor can orders from multiple accounts be combined to achieve reward thresholds.
We do not accept returns or offer exchanges for loyalty rewards, except where required by applicable law.
If an account is closed or canceled before a loyalty reward is issued or applied, the reward will be forfeited and not be sent, fulfilled or applied.
Loyalty rewards do not expire while the Loyalty Rewards Program remains active, subject to account status and these Terms, and will remain available in your account if your subscription is closed and then later reactivated using the same email address, provided you qualified for the reward in accordance with program terms and the account remains open at the time of issuance.
Exclusions
Loyalty rewards are not redeemable for cash, have no cash value, and are non‑transferable. Unless explicitly stated otherwise, loyalty rewards cannot be combined with other promotional codes, discounts, or offers. Loyalty rewards, including discounts and gifts, may not be applied to the purchase of gift cards, taxes, shipping, or handling fees, and may be restricted where prohibited by law.
Canceled, Returned, or Ineligible Orders
Orders that are canceled, refunded, returned, charged back, or otherwise not successfully completed do not count toward loyalty rewards progress. Any rewards associated with such orders may be removed or adjusted accordingly.
Caps, Fair Use, and Program Integrity
Freshpet may set or update reasonable limits on loyalty rewards (including milestone thresholds, discount amounts, or reward frequency).
We may withhold, modify, or revoke loyalty rewards if we reasonably determine that a customer has engaged in misuse, abuse, fraudulent activity, excessive returns, account manipulation, or conduct that violates these Terms or applicable law. Decisions regarding misuse or abuse are made in our reasonable discretion and are final, subject to applicable consumer protection laws.
Freshpet is not responsible for system errors, delays, or inaccuracies in reward tracking or account display, but will make reasonable efforts to correct verified errors.
Loyalty Rewards Program Communications
Freshpet may send program-related emails or notifications, such as updates on rewards progress, earned benefits, or upcoming milestones. These communications are considered part of the Loyalty Rewards Program. By participating in the Loyalty Rewards Program, you consent to receive these program‑related communications.
Separate promotional or marketing communications are governed by your communication preferences and Freshpet’s Privacy Policy.
Tax Responsibility
Customers are responsible for any and all federal, state, or local taxes associated with receipt or use of loyalty rewards.
Program Changes
We may change, suspend, or end the Loyalty Reward Program or these Terms (prospectively) at any time, with or without notice. This includes changes to reward structures, eligibility requirements, earning thresholds, and available benefits.
If the Loyalty Reward Program is terminated, any unredeemed loyalty rewards may be forfeited, except where prohibited by law. Freshpet will not be liable for any loss or perceived loss resulting from Loyalty Reward Program changes or termination.
